In consideration of being permitted to participate in any way in the Kicking Dragons Circle Martial Arts (KDC Martial Arts) program indicated below and/or being permitted to enter for any purpose any restricted area (herein defined as any area where in admittance to the general public is restricted or any area where in any aspect of the program or related activities take place) or to participate in any and all related events and activities of KDC Martial Arts, the undersigned acknowledges, appreciates, and agrees that:
The undersigned, the parents and/or legal guardian of a minor, participating in any KDC Martial Arts activity or event, should inspect the facilities and equipment to be used, and if they believe anything is unsafe, the participant should immediately advise KDC Martial Arts of such conditions and refuse to participate. I/WE, the undersigned, understand and agree that, if at any time, I/WE feel anything to be UNSAFE; I/WE will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.
I/WE knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation.
I/WE willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.
4. I/WE HAVE fully understood and acknowledge that:
(a) There are risks and dangers associated with participation in KDC Martial Arts events and activities, which could result in bodily injury partial and/or total disability, paralysis and death.
(b) The social and economic losses and/or damages, which could result from those risks and dangers described above, could be severe.
(c) These risks and dangers may be caused by the action, inaction or negligence of the participant or others, including, but not limited to, the Releasees named below.
(d) There may be other risks not known to us or are not reasonably foreseeable at this time.
I/WE accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.
I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the KDC Martial Arts facility used by the participant, including its owners, managers, promoters, lessees of premises used to conduct the KDC Martial Arts event or program, premises and event inspectors, underwriters, consultants, and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the facility or events held at such facility and each of them, their officers, agents and employees, all of which are referred to as “Releasee” FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal representatives, assigns, executors, heirs, and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES ON ACCOUNT OF ANY INJURY, including, but not limited to, death or damage to property, CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.
I/WE HEREBY acknowledge that THE ACTIVITIES OF THE KDC Martial Arts ARE POTENTIALLY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each participant and parent(s) or legal guardian(s) of the participant, expressly and voluntarily assumes all risk of death or personal injury sustained while participating in KDC Martial Arts events whether or not caused by the negligence of the Releasees.
I/WE further acknowledge that I/WE am/are not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in KDC Martial Arts activities. I/WE further agree that I/WE will not participate in any KDC Martial Arts activities while under the influence of alcohol or any illicit or prescription drugs which would impair my ability to safely participate in KDC Martial Arts activities.
This Waiver and Release of Liability shall remain valid and in full force and effect, and shall apply to all future participation in any KDC Martial Arts events or activities by the undersigned.
